These Terms of Use ("Terms") govern your access to and use of the NailApp mobile application ("App", "Service"), operated by Rita Bohoslavska, Sole Proprietor, Bern, Switzerland ("we", "us", "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of the Service
NailApp is a mobile application that allows users to upload images of their nails and receive AI-enhanced nail design transformations.
The Service may include:
- AI image generation and enhancement
- Free trial access
- Recurring subscription plans
- One-time credit purchases
- User account functionality
- Access to generation history
We reserve the right to update, modify, suspend, or discontinue the Service at any time.
2. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the App.
3. User Accounts
You may be required to create an account. You agree to provide accurate information and keep your login credentials secure.
You are responsible for all activity under your account. If you suspect unauthorized use, contact us immediately at: feedback@nailapp.app
4. Free Trial
New users may receive a limited free trial. We reserve the right to modify or discontinue free trials at any time.
Free trial access does not guarantee continued free use of the Service.
5. Subscriptions and Purchases
5.1 Subscription Plans
We may offer subscription plans. These renew automatically unless canceled before the end of the current billing period.
5.2 Billing
Payments are processed via Apple App Store or Google Play.
Subscriptions automatically renew unless canceled at least 24 hours before renewal.
5.3 Credits
Users may purchase credits. Credits are non-transferable and non-refundable once used.
Upon account deletion, unused credits are permanently forfeited and will not be refunded or transferred.
5.4 Cancellation
You can manage or cancel subscriptions through your Apple or Google account settings.
6. Refunds
Payments are processed through Apple App Store and Google Play. Refunds for subscriptions are subject to the refund policies of Apple and Google respectively. We do not issue refunds directly. If you believe you are entitled to a refund, please contact Apple or Google support. Unused credits are non-refundable. Upon account deletion, any remaining unused credits will be forfeited and are not eligible for compensation.
7. User Content
You retain ownership of images you upload.
By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to process, modify, and generate AI outputs to provide and improve the Service.
8. Acceptable Use
You agree not to:
- Upload illegal or harmful content
- Use the Service for unauthorized commercial purposes
- Attempt to reverse engineer or disrupt the Service
9. Intellectual Property
All rights to the App, including software, AI models, and branding, belong to Rita Bohoslavska.
10. AI Disclaimer
AI-generated results may vary. We do not guarantee specific results.
You are responsible for how you use generated content.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages.
Total liability is limited to the amount you paid in the last 12 months.
12. Termination
We may suspend or terminate your access if you violate these Terms.
13. Governing Law
These Terms are governed by the laws of Switzerland. Jurisdiction: Bern.
14. Changes to Terms
We may update these Terms at any time. Continued use means acceptance of updates.
